This Privacy Statement is in force as of 25 May 2018. For FCR, the privacy of its customers is very important. We therefore want to be transparent about what personal information we collect from you, why we collect it and what we do with it. In addition, we want you to know your rights with regard to this personal data. For these reasons, we strongly advise you to read this Privacy Statement and to contact us if you have any questions.

1. Definitions

The following definitions will help you better understand the Privacy Statement:

2. What is the scope of this Privacy Statement?

This Privacy Statement applies to all personal data of website visitors, applicants, customers and potential customers collected and used by FCR. This includes information that FCR collects through its Websites, information that our (potential) customers spontaneously provide, as well as data collected offline for commercial use, which is managed by us.

This Privacy Statement has been drawn up and is kept up-to-date in accordance with the provisions and requirements of the privacy regulations, the General Data Protection Regulation (abbreviated to ‘GDPR’). This means that FCR processes personal data in accordance with the principles for processing as described in the GDPR.

3. Who is responsible for your personal data?

FCR Media Belgium NV, Uitbreidingstraat 82, 2600 Berchem, Belgium, is responsible for the processing of your personal data.

4. What data do we collect from you and for what purpose do we collect it?

4.1. Processing of personal data included in the Yellow Pages, White Pages and our other online platforms with company information

4.1.1 Yellow Pages and White Pages

One of FCR’s services is the publication and distribution of the Yellow Pages and the White Pages. This concerns both the distribution of directories in printed form (paper directories) and in electronic form (internet, smartphones, etc.). The following personal data may be processed: surname and first name, address, e-mail address, telephone number, photos and payment details. The data we use for the publication of the Yellow Pages and White Pages are taken from our database, where they are completed with information from other sources.

For the commercial advertisements in the Yellow Pages, the processing of personal data is legitimate because of the existence of an agreement between yourself and FCR. For the free advertisements, the publication is lawful because of a legitimate interest of FCR. You can decide at any time to no longer make use of this free listing, see point ’10. The publication of the White Pages and the personal data included in it is legitimate because it represents a task of public interest. The personal data included in the White Pages are only used for their publication. You may decide at any time to no longer appear in the White Pages, see point ’10. Where can you ask questions or complain? of this Privacy Statement.

If you no longer wish to receive the paper version of the Yellow Pages and/or White Pages, we need your personal data so that we can ensure that we are processing the request from the right person and that we are not deleting the wrong person from our file. For this purpose we ask you to provide us with the following information: surname and first name, address, telephone number and e-mail address.

There is a share button on our Yellow Pages website. This button allows users of the website to easily share the published data via the following channels: e-mail, Whatsapp, Twitter, Facebook and Messenger. In this way, a user can share the name, the link to the relevant Yellow Pages page and (depending on the chosen platform) a photo with another user through these channels.  For the processing of the data, FCR invokes the legitimate interest, as the published data will reach potential customers more quickly in this way. You can inform us at any time that you do not wish (or no longer wish) that your data can be shared on the aforementioned platforms, see point ’10. 4.1.2 Wijwerken.be and Obodo.be

Our platforms Obodo.be and Wijwerken.be also focus on the distribution of the abovementioned data. The personal data processed are the same or a subset of those published on the Yellow Pages website. Obodo focuses on B2C headings and user content. At Wijwerken a user or business owner can indicate whether or not a company offers certain services. The user provides his name and e-mail address for this purpose. This data is not published anywhere but only stored in our system to prevent abuse.

The processing of personal data is lawful due to a legitimate interest of FCR taking into account (i) the special nature of the (personal) data concerned (i.e. data relating to natural persons always acting in a professional/commercial context) and (ii) the fact that FCR may reasonably assume that the persons concerned have no objection to the publication of their data on a platform that increases the online visibility of their company or professional activity.

4.1.3 Aztrix

In addition to the processing of the abovementioned personal data for publication on the Yellow Pages, the White Pages, Wijwerken.be and Obodo.be, these data are also passed on to Aztrix, a partner specialized in managing contact details and consent. Aztrix has developed a platform that allows both SMEs and individuals to manage their (company) profile, contact details and (possibly) consent for the processing of their personal data under the GDPR by third parties. Through this tool, both parties have a clear overview of what data they share with whom and why. Through Aztrix, companies can give or withdraw permission to be published on the Yellow Pages & Wijwerken.be, modify incorrect data and add missing data.

FCR is of the opinion that it can invoke the legitimate interest for the transfer of the data to this partner taking into account (i) the special nature of the (personal) data concerned (i.e. data relating to natural persons always acting in a professional/commercial context) and (ii) the fact that FCR can reasonably assume that the persons concerned do not object to the transfer of their data to a partner that increases the online visibility of their business or professional activity and gives them the opportunity to manage their business in accordance with the GDPR.

Both on the Yellow Pages and on the Wijwerken website you will find the button “Are you the owner of this business?”. Through this button the owner of this listing can claim his business. By clicking this button, the owner can, via Aztrix, adjust and/or supplement his company details

4.2 Processing of personal data in providing our digital marketing services

In addition to the publication of the Yellow Pages and White Pages, FCR also provides many digital marketing services. We design websites and webshops (or give you the opportunity to do so yourself), increase the online visibility and findability of your company, make sure you are visible with the right data, offer an online reservation system, place your ads on social media sites and advertise via search engines such as Google, making your company appear above other search results. The following personal data can be processed: surname and first name, address, email address, IP address (in case of digital orders), photos, videos, telephone number and payment details. Depending on the service and advertising medium you have chosen and the information you have provided to us, more or less information may be published. This includes logos, websites and other business-related information.  The processing of personal data in the performance of these services is necessary so that we can display the correct information about your company online and to correctly manage the contract you have concluded with FCR.

If a customer buys a webshop from us, FCR has access to all personal data entered by you (or your customers) in the platform. However, FCR will not use these for its own (commercial or other) purposes. All data in the platform are accessible to FCR in order to guarantee (remotely) an optimal service to the customer (e.g., adjustment of settings/preferences, demonstration of the possibilities of the platform, etc.).

The processing of the data is lawful because of the existence of an agreement. For some of the services mentioned above, you have the possibility to manage your purchased product yourself and change certain data. You gain access by entering a user name and password. This possibility only exists for our services Websites and Netsync. For the services where you cannot change the data yourself, you can always contact our customer service department for any changes to be made.

By means of cookies, Facebook pixels and/or certain algorithms that are processed in the products purchased by you, FCR can process the following data about your customers: IP address, location data, device type, browser type and/or operating system and search, browse and click behaviour. FCR only uses this data to provide you with anonymous statistics relating to your products.

4.3 Processing of personal data when providing an online (CRM) platform for optimal customer management

If you have decided to use the online (CRM) platform for optimal customer management offered by FCR (whether or not via the platform Sitee.io), FCR must process the following data in order to create your account: name, telephone number, address, e-mail.  The processing of the data is legitimate due to the existence of this agreement.

FCR has access to all personal data entered by you (or your customers) in the platform, but will not use it for its own (commercial or other) purposes. All data in the platform are accessible to FCR in order to guarantee (remotely) an optimal service to the client (e.g. adaptation of settings/preferences, demonstration of the possibilities of the platform, etc.).

4.4 Processing of personal data by providing data to other companies that commercialize data (data partners)

FCR may commercialize the data contained in its databases and supply them to data partners for the following purposes:

Direct marketing purposes of data partners: sale of the data, use of the data for marketing purposes or file building on behalf of third parties, use of the data for validation and for file enrichment;

Offering statistical analysis products and publication or sale of these analyses by data partners;

Commercialization of data elements by data partners that have been created by comparing the data from our database with other data sources of those data partners.

The following personal data may be processed: name and first name, address, e-mail address, telephone number, gender, financial data and company-specific information. It is contractually agreed with these data partners that they may only use these data for the abovementioned specified purposes.

For customers, the transmission of this data to data partners is an integral part of the services they have chosen and of FCR’s general terms and conditions, and the transfer also intends to increase the visibility and awareness of your company. The processing here is lawful because of the agreement you have entered into with FCR. You can always ask FCR to stop sharing your data with data partners. Also for those companies who do not have an agreement with FCR and only have a free listing, there is the possibility to request that your data is no longer shared with our partners, see point ’10. 4.5 Processing of personal data in MyMedia, your business center and the Sitee.io platform

FCR offers a MyMedia platform. Currently, access to the platform is only offered to new customers in Belgium. Eventually, it is the intention that all our customers will be able to use it. On the MyMedia platform you will get an overview of the services you purchase and have purchased from FCR in the past and you will get statistics about the results of this service for your company. In addition, the following personal information about you is displayed on your profile page: surname and first name, address, e-mail address, telephone number, payment details and an overview of your invoices, payment status and an overview of your concluded contracts. We use this data to give you a good overview of which data we use from you for the execution of the agreement we have concluded with you. You can also modify this information in MyMedia yourself if it is incomplete or incorrect. The access to your account on MyMedia will be closed after the end of the agreement. Cookies are also placed on the MyMedia platform.

There is also a business center, which will be rolled out in a test version to a limited group of selected customers.  In this new platform, they will be able to modify their data, view statistics of their products, purchase additional products from FCR media, … After a test version, this will be further evaluated. On this platform, customers will be able to log in using their own username/password or a Google account. The functionalities and data displayed and stored are in line with those of MyMedia.

The Sitee.io platform offers (some of) our products. You can create an account on this platform and purchase (some of) our products and manage them afterwards. The personal data that are processed are those that are communicated when the account is created (email, name, etc.) and the personal data that are required to bring the products purchased by you live and manage them.

4.6 Processing of personal data of users of our Websites

FCR processes personal data gathered via the Websites at various times. This is the case when, for example, you surf on our Websites or use the search engine on the Websites. By means of cookies, Facebook pixels and/or certain algorithms, FCR can process the following data: IP address, location data, device type, browser type and/or operating system and search, surf and click behavior. FCR uses this data so that you can make full use of our Websites.

Also when you write a review on our Websites, FCR will process the personal data you provide, more specifically name and/or e-mail address. Finally, if you make an appointment or request an offer from one of our advertisers via our Websites, FCR will process your e-mail address (as well as the date and time of your request) in order to ensure a correct follow-up of the requested appointment/offer. FCR may lawfully process these personal data based on the consent you give when sending the review, your request for an offer or request to schedule an appointment. 4.7 Processing of personal data for FCR’s direct marketing purposes

You can always subscribe to one of our newsletters. Through our newsletters, we can keep you informed about FCR’s services as well as changes and evolutions that occur in the market. We are also happy to inform existing customers about products and services similar to those they have purchased from us. For this purpose, we use the following personal data: surname and first name, address, e-mail address, telephone number and information about the services you purchase from FCR. In this way we can make the information more interesting and personal for you. We may also use this information to invite you to events and training sessions that we organize. We also use social media channels to promote our services and events.  You can decide at any time to no longer receive these communications, see point ‘9.7. Right to withdraw your consent‘ and ‘10. 4.8 Processing of personal data by DexVille, FCR’s digital marketing agency

DexVille was founded in order to be able to offer more tailor-made online marketing campaigns, mainly to larger customers. In addition to the products (and data processes) already mentioned in this privacy statement, DexVille offers solutions that are specifically tailored to the needs of the customer (such as e-mail campaigns, websites, …). The personal information processed depends on the program developed for the customer. For each of these tailor-made programs, DexVille draws up a Data Processing Agreement which is signed by both parties before the data is processed. In this way, it is clear to both parties which data is being processed, for what reasons, under what conditions, ….

4.9 Processing of personal data to answer request for quotes

You can request a quote for our services and products via a contact form, both via our own website www.fcrmedia.be and via partner websites. In order to register you in our systems and to be able to contact you again for the requested quote, we process the following personal data: surname and first name, address, e-mail address, telephone number and any additional personal information you may provide.

4.10 Processing of personal data through reporting

FCR also uses your data to create reports and carry out analyses in order to gain more insight into its services and to improve its way of working. The following personal data are processed: surname and first name, address, e-mail address, telephone number, financial data and information about the services you use from FCR or in which you are interested. The processing of these data in order to improve our services and our range of services is legitimate because of the legitimate interest that FCR has in this improvement of services.

4.11 Processing of personal data in the case of spontaneous applications

Through our website http://careers.fcrmedia.be you can apply spontaneously for one of our vacancies. We ask you to provide the following personal data: surname and first name, sex, mother tongue, date of birth, the municipality where you live, e-mail address, telephone or mobile phone number, your preference regarding the department where you would like to be employed, your CV and a motivation letter. If there are temporarily no vacancies of interest to you, you can also leave the above details and be contacted later when there is a new vacancy. The processing of these personal details is lawful because of the permission you have given. The data will only be used for application and recruitment purposes. You can withdraw your consent at any time, see point ‘9.7. Right to withdraw your consent‘ and ‘10. Where can you ask questions or complain? of this Privacy Statement.

4.12 Processing of personal data for data quality and for CRM purposes

FCR receives data from third parties with a view to enriching its own databases. In this way, FCR can verify the accuracy of the data in the databases and guarantee the quality of the databases. This is necessary so that we can publish the correct information and include it in our products (e.g. on the website we create for you). We also use the data to inform potential customers about our services and products. Potential customers can also take the initiative and let us know that they are interested in our services and products. They can do this by leaving their details via “add your company“. The following personal data can be processed here: surname and first name, address, e-mail address, telephone number, gender, language, financial data and company-specific information such as company name and company number.

FCR only receives personal data for which the third party has a legitimate legal basis to pass on these data (e.g. consent of the data subject or a legal obligation). The processing of these data is necessary so that FCR can fulfil its obligations under the agreement between yourself and FCR. The processing of the data we receive via “add your company” is legitimate because it is based on your consent. You can revoke this consent at any time, see point ‘9.7. Right to withdraw your consent’ and ‘10. Where can you go with questions or complaints’ of this Privacy Statement.

FCR also uses your personal data for certain CRM activities, namely in the context of customer retention and when sending out satisfaction surveys. For customer retention purposes, the following personal data are processed: surname and first name, telephone number, e-mail address and payment details. We use the following personal data to conduct satisfaction surveys: surname and first name, telephone number and e-mail address. The use of these personal data for both purposes is justified by the existence of legitimate interests for FCR.

4.13 Processing of personal data by our customer service department

For all your questions, comments or complaints about our services, please contact our customer service department. You can also contact the customer service department if you want to change certain information about your company (or yourself) in the service you bought from us. You can email the customer service department. The following information can be collected: surname and first name, e-mail address, telephone number, address, company information and information about your question. FCR only uses this information to respond to your question or complaint in the best possible way. The use of these personal data for this purpose is justified by the existence of a legitimate interest for FCR.

Incoming telephone calls to our customer service department are recorded for training and coaching purposes. The recordings are kept for no longer than strictly necessary and are not accessible to unauthorized persons.

You can also be called by our customer service department as part of the monitoring of your program.  During the call, the following information may be collected: surname and first name, e-mail address, telephone number, address, company information. FCR only uses this information to optimize its services/products. The use of personal data is justified by the existence of a contract with FCR. If the conversation is recorded for training and coaching purposes, you will be informed of this at the start of the conversation. You can always object to the recording of the conversation if you wish to do so. The recordings are kept for no longer than strictly necessary and are not accessible to unauthorized persons.

FCR can call on (sub)processors for the processing and further follow-up of customer queries. For more information on this, please see point 6 of this Privacy Statement.

When you visit our Websites, a pop-up may appear that allows you to chat “live” with one of our staff members. FCR may legitimately process the personal data that you would provide during a chat session (e.g. name, address, telephone number, …) as FCR has a legitimate interest in doing so.

4.14 Processing of personal data in the context of the performance of a contract

If you have purchased a paid service from us, we need personal information from you to register, process, bring online and invoice your order. These personal details are surname and first name, e-mail address, company address, billing address, payment details and bank account number and sometimes your telephone or mobile number. The processing of these data is lawful because of the agreement you have concluded with FCR.

The registration of your order can be done by phone. In that case, part of the sales conversation will be recorded in order to prove the existence of a contract. Of course, this will always be mentioned by the concerned salesperson and the approval will also be recorded.

At regular intervals we will also send you surveys after certain moments of contact with our company (contact with our customer service department, the coming online of certain products, …). The aim is to improve our services and to help you as much as possible. The processing of these data is legitimate because of the agreement you have concluded with FCR.

4.15 Processing of personal data for FCR promotional purposes

Provided you have given your express consent, FCR may use the following personal data for the purpose of promoting the company (e.g. through testimonials, photos, videos, quotes, etc.): surname and first name, address, telephone number, e-mail, photo, video. You can revoke this permission at any time, see point ‘9.7. Right to withdraw your consent‘ and ‘10. Where can you go with questions or complaints? of this Privacy Statement.

4.16 Processing of personal data to comply with legal obligations

FCR also processes personal data to comply with the laws and regulations applicable to FCR. This includes, among other things, accounting and tax regulations, labour legislation, … It is possible that, in order to comply with these legal provisions, your personal data may be shared with other authorities.

4.17 Processing of personal data for the security of the company building

A (surveillance) camera was installed in the entrance hall of FCR in order to monitor the company building and to control which persons enter the building. Employees, visitors and suppliers of FCR are informed about this via the appropriate pictograms, which were hung in clearly visible places. The camera images can only be consulted in real time and are not stored. FCR can lawfully process the recorded images on the grounds of legitimate interest.

5. Provision of data to third parties

FCR shares your data with third parties, including for the purposes described in ‘4.3. Processing of personal data by supplying data to data partners’. You can oppose this processing at any time see ’10. Where to go with questions or complaints” of this Privacy Statement. In addition, your data will only be provided to third parties if FCR is obliged to do so under applicable laws and regulations, e.g. to the police within the framework of a criminal investigation.

FCR does not provide personal financial information (such as credit card information) to other parties, unless this is necessary to process your service request, process our invoice, or prevent or combat fraud.

Sometimes our Websites contain links to other websites. You should carefully review the privacy policies of those sites; they differ from our Privacy Statement.

6. Processors

FCR may make use of other service providers for the processing of personal data who will act as processors, exclusively on behalf of FCR. These processors may therefore not use these personal data for their own (commercial) purposes. FCR selects these partners carefully and expects them to be as conscientious with your personal data as FCR itself.  We enter into a processing agreement with these processor(s) in which the processor is obligated to comply with the obligations of this Privacy Statement, as well as the provisions of the GDPR.

The previous paragraph also applies to processors that offer systems/tools in which the (central) processing (e.g. storage, update, correction, …) of personal data held by FCR is carried out. Such data systems/tools are necessary to support the different services/products offered by FCR.

7. Security of your personal data

We recognize our responsibility to provide an appropriate level of security for the information you entrust to us. FCR has therefore taken various measures to protect personal data against loss, misuse and unauthorized access, disclosure, alteration or destruction. Organizational measures include limited access to and monitoring of buildings, systems and files; as well as technical measures including firewalls, protection through personal passwords and authentication, as well as authentication requirements for access to personal data on a need-to-know basis.

We also expect our processors to be able to guarantee an appropriate level of security when processing personal data for FCR. The necessary agreements are taken up in the contracts between FCR and the processors.

8. How long do we keep your data?

FCR has developed a policy on the retention of personal data. We ensure that the data is kept in a secure manner and that we do not keep it longer than necessary to achieve the purposes mentioned above. The time that the data will be kept is therefore dependent on the purpose for which it was collected. If you would like FCR to stop keeping your personal data, or if you would like more information about the retention periods we use, please contact our customer service department. 9. What rights do you have and how can you exercise them?

FCR uses the personal data of its customers, potential customers, applicants and website visitors for specific purposes and only collects the personal data it really needs to achieve those purposes. We want to be as transparent and clear as possible about the activities for which we collect, use and secure your personal data. Consequently, FCR has developed a policy so that you can exercise your rights with regard to the personal data you have entrusted to us. In accordance with the applicable privacy legislation, you have various rights.

9.1 Right to view your data

You have the right to ask FCR at any time what information we hold about you and what we use it for and you can request a copy of it. In this way, you can also ask how long we keep your data, on what legal basis (consent, contract, legal obligation, legitimate interest, public interest, vital interest) we process your data, etc. By exercising this right, you can also check whether the data we have about you is correct. Where can you go with questions or complaints’ of this Privacy Statement.  If you have a MyMedia-, Websites- or Netsync account, you can always find an overview of the information we have about you.

9.2 Right to correct your data

If you notice that any personal information we hold about you is incorrect or incomplete, you can have it corrected or supplemented. You can contact the customer service department by e-mail. If you have an online account on MyMedia, or have purchased our Website or Netsync product, you can also correct or supplement certain personal data yourself.

9.3 Right to erase your data

You have the right to request that FCR erases the personal data it holds about you. Please note that this right is not absolute. The GDPR determines the conditions under which this right can be exercised. The customer service department will assess whether one of the conditions is met. If they are of the opinion that one of these conditions applies, your personal data will be deleted. If your data has been passed on to our processors for certain purposes, FCR will inform all these processors that they must also delete the data. Please note that if you request to exercise this right, all your personal data held by FCR will disappear. If you wish to use our services again afterwards, you will have to communicate some of these data again.

9.4 Right to request the limited processing of your data

By requesting the limited processing of your personal data, it remains possible for FCR to keep track of the data, but the use of the data is limited. The exercise of this right only applies in limited cases. If FCR nevertheless wishes to do other things with your data than merely keep the data, this will only be possible in limited cases (e.g. by requesting your permission again for the processing of your data). 9.5 Right to object to the processing of your data

You have the right to object to the processing of your data where such processing is based on a public interest or the legitimate interest of FCR. Under chapter ‘4. What data do we collect from you and for what purpose do we collect it? You can find the activities for which FCR has a legitimate interest or a public interest. If you invoke this right, FCR will examine whether its legitimate grounds for processing outweigh your interests, rights and freedoms. If this is not the case, FCR will no longer process your data for that purpose.

You can also object to the processing of your personal data for direct marketing purposes. If you invoke this right, FCR will no longer process your data for marketing purposes.

9.6 Right to transferability of your data

This right means that you will receive back the data you have given to FCR. However, this right only applies to the processing of data based on your consent (e.g. consent to the sending of the newsletter) or on a contract (e.g. contract concluded when you purchase a digital marketing service from FCR). An additional aspect of this right is that you can go to another processing manager with the data you receive back without FCR being able to object. Please note, however, that this only concerns the data that you have provided directly to FCR. You can read how to exercise this right under point ‘10. 9.7 Right to revoke your consent

As previously mentioned, you can revoke your consent at any time for all processing operations for which FCR requests your consent. Please note, however, that revocation of your consent does not affect or detract from the processing operations carried out by FCR when your consent was not yet revoked. There are several ways to revoke your consent:

You can unsubscribe from newsletters, direct marketing campaigns and other tailor-made information via the unsubscribe link at the bottom of the newsletters and other communications sent.

You can fill in the contact form that is handled by our customer service department. You can use this contact form to request that you withdraw permission to receive, among other things, communications about open vacancies if you have applied spontaneously to FCR. You can also use the contact form to unsubscribe from newsletters, direct marketing or other customized information.

Please bear in mind that a certain processing time is required to process your request and that in the meantime there is a chance that you will receive the information one last time. This processing time will be kept to a minimum.

10. Where can you go with questions or complaints?

As stated earlier in the declaration of your rights, you can exercise your rights by contacting our customer service by e-mail for questions or complaints regarding the processing of your personal data or questions about this Privacy Statement. You can also send an e-mail to info@fcrmedia.be with your question or complaint.  We ask you to provide a number of details as well as which right you wish to exercise or which question or complaint you have with regard to the processing of your personal data.

We ask for your personal information so that we can uniquely identify you in our systems and certainly not share personal information with individuals who impersonate someone else.  We will ask you for the following information: surname and first name, address, company, VAT number and customer number (in case you use FCR services with your company), telephone number, e-mail address, which right you wish to exercise and additional information about your question or complaint. All requests will be addressed to the customer service department. As soon as they have received your request, they will send you an e-mail confirming that your request is being dealt with. You will receive a final answer within one month after the customer service department has received your question.

We will do everything in our power to answer or resolve your questions and complaints in the best possible way. 11. Applicable law

This Privacy Statement is governed by Belgian law. All disputes arising out of or in connection with this Privacy Statement will exclusively be submitted to the competent courts of Antwerp.
